Sub: Judgement of the Madras High Court dated 12.08.2022
In WP14707 of 2022, you have been arrayed as Respondents 1-5. The Hon’ble Madras High Court has been pleased to dispose of the same vide judgement dated 12.08.2022. The Court has reiterated that under the Scheme of the AVF Act, the Residents’ Assembly has the right to choose their own Working Committee. As the judgement states in para 45:
“It is also made clear in Section 20 (3) of the Act that the manner of choosing the members of the Working Committee and their term of office shall be such as may be decided by the Residents’ Assembly. Therefore, the Working Committee is chosen only by the Residents’ Assembly and its term of Office is also decided by the Residents’ Assembly.”
The present members of the Working Committee have been elected on 27th June 2022 by the Residents’ Assembly as follows:
Aravinda Maheshwari, Chali Grinnell, Hemant Lamba, Ilayabharathy Somasundaram, Mael Shanti Vidal, Sauro Mezzetti, Valli Senthilkumar
The resolution of the Residents’ Assembly is attached for your reference.
We, the Working Committee of the Residents’ Assembly of Auroville, intend to follow and comply with the judgement of the High Court. We request that you comply with the same and ensure that we are given back access to our office and records in order for us to assist the Residents’ Assembly in various matters including completing the updation of the Register of Residents in accordance with the Act and Rules and in compliance with the direction of the Madras High Court in its judgement dated 12.08.2022.
You are requested to comply with the judgement of the Madras High Court within a period of 5 days, i.e. 22nd August 2022, and ensure that all office spaces, records and email accounts are restored to the legitimate Working Committee of the Residents’ Assembly of Auroville.
Please be advised that refusal or non compliance with the judgement of the High Court would constitute Contempt of Court and would require us to bring the same to the notice of the High Court.
